It's that provision opponents are keying in on. Lawyers for the Washington, D.C.-based Can Manufacturers Institute, a trade association, say the state has no authority to require warning labels.
Such a warning 'conveys a threat to human health that is unsupported by credible scientific evidence and stands in opposition to the conclusions about the safety of BPA drawn by [the] FDA and other federal and international public health bodies,' lawyers Steven J. Rosenbaum and Miriam J. Guggenheim of the Washington, D.C., firm Covington & Burling wrote.
State Attorney General Richard Blumenthal disputed the claim Thursday, saying the legislature can require warning labels without violating federal law."
